Do I Qualify? Find Out About Surrogate Requirements

Les Petits Surrogacy® is a nationwide and international agency.

Do You Qualify to Become a Surrogate?

Helping another family build theirs starts with meeting a few basic qualifications. If you’ve had a healthy pregnancy and want to make a lasting difference while receiving excellent compensation and support, you may already qualify.

Our agency’s surrogate requirements are in line with state laws, as well as all standards that support ethical and safe surrogacy. These guidelines are designed to ensure that our surrogates are physically, emotionally and mentally ready for pregnancy, and they also protect the baby by ensuring a healthy gestational environment.

What are the basic qualifications to become a surrogate?

To ensure a safe and healthy journey for everyone involved, our gestational surrogates must meet the following requirements:

  • Age 21 to 41
  • United States citizen or legal resident
  • Healthy height-to-weight ratio, often referred to as body mass index (BMI)
  • Have had at least one full-term, complication-free pregnancy
  • Have had no more than two C-section deliveries
  • No criminal record
  • No history of illegal drug use
  • Non-smoker/non-vaper and no current marijuana use
  • Financially stable, not heavily dependent on any state or federal financial assistance
  • Not currently taking medication for anxiety or depression
  • Live in a surrogacy friendly state. (all states in the US are friendly except NE, LA, IN, MS, AL
    and KY)
  • Comfortable leaving all decisions regarding termination and fetal reduction up to the intended parents

Why these requirements matter

These guidelines aren’t meant to discourage you. They’re designed to protect your health, support a healthy pregnancy, and give intended parents the best possible chance of bringing home a healthy baby. They also help ensure your surrogacy journey is as safe and rewarding as possible.

Do you live in a surrogacy-friendly state?

Because surrogacy laws vary by state, we work with women who live in states that support gestational surrogacy. Surrogacy regulations in the United States vary state by state and can change occasionally. These states allow all hopeful parents to pursue surrogacy, let the baby’s parents put their names on the birth certificate, and allow parents to legally establish their parenting rights before the baby is born. Reach out for more information if you are interested in becoming a surrogate, but are unsure if the state you reside in is surrogacy friendly.

If you’re unsure whether your state qualifies, simply contact us. We’ll be happy to help.
